Agreement
These Terms of Service (“Terms”) are an agreement between you and Santa Ana for Digital Marketing LLC, which trades as Bounty (“Bounty”, “we”, “us”). By using www.bounty.fm, applying for a campaign, or using the partner portal, you agree to these Terms and to our Privacy Policy. If you use Bounty for a company, you confirm you're authorized to bind it. You must be at least 18 years old.
What Bounty provides
- Chart explorer. Free pages showing Apple Podcasts chart positions and history.
- Campaigns. Rewarded ad campaigns, built from a podcast's published content, that aim to grow followers and chart position.
- Partner portal. Tools for partners and agencies to view campaigns, build proposals and share reports.
We may change, add or remove features over time.
Free trial campaigns
When you apply for and accept a free trial campaign:
- You consent to a free promotional campaign for your podcast, lasting up to 7 days, aimed at the chart position you choose.
- No obligation. A trial doesn't commit you to further work. There are no lock-in periods or initiation fees, and after the trial you decide whether to continue.
- Results and testimonials. If your podcast achieves notable results during a trial or paid campaign, we may refer to your podcast, its name and artwork, and its chart results as a testimonial or example of our work.
- Communication. If we haven't heard back from you within 7 working days after sending trial results, we may decline future trial or campaign requests for that show.
- Methods. We may combine ad formats and use promotional methods we don't publicly describe to reach your target chart position.
- Limited performance commitment. We don't guarantee specific listener counts, episode consumption, retention or overall growth. Our aim in a trial is the chart position within the geography you specify.
- We choose which shows receive trials, and may decline any application.
Paid campaigns
Paid campaigns are described in a proposal, order or invoice (an “Order”) that sets out the pricing model, such as pay per download or Guaranteed Charting, the target, the schedule and the fees. If an Order conflicts with these Terms, the Order wins for that campaign. Unless an Order says otherwise, fees are due as invoiced, are non-refundable once a campaign starts delivering, and exclude taxes, which you're responsible for. Any guarantee, such as a chart position under Guaranteed Charting, applies only as written in the Order, together with its remedy.
Reports
Campaign reports combine Apple Podcasts chart positions with delivery data from our ad partners. Some figures, such as downloads, may be estimated from engagement data rather than measured directly.
Your show and content
You keep all rights in your podcast. You grant Bounty a non-exclusive, worldwide, royalty-free license to use your podcast's name, artwork, episodes, transcripts and related public materials to create, test, run and report on campaigns and creative for you, and as described under Results and testimonials. You confirm you have the rights needed to grant this license, including for guests and music in your episodes.
Partner accounts and shared links
Keep your login details confidential; you're responsible for activity under your account. Reports, ad samples and other links we share with you may be password-protected and are confidential. Don't share their passwords or contents beyond the people they're intended for without our permission.
Acceptable use
You agree not to:
- Scrape, crawl or bulk-download our chart and show pages or data, or access them with automated tools, except through search engines indexing the site in line with our robots.txt.
- Interfere with or overload the site, bypass security or rate limits, or probe for vulnerabilities without our written permission.
- Reverse engineer our services, or use them to build a competing product.
- Submit content you don't have the rights to, or that is unlawful, misleading or infringing.
- Use Bounty in violation of any law or of Apple's or any platform's terms.
Chart data
Chart positions on our site come from Apple's public feeds and other sources, recorded once a day. They can lag or differ from what Apple shows at a given moment, and we don't guarantee their accuracy or completeness. Bounty isn't affiliated with or endorsed by Apple. Apple Podcasts is a trademark of Apple Inc. Podcast names and artwork belong to their owners.
Our intellectual property
The site, the Bounty name and logo, our software, ad formats, reports and the compilation of our chart data belong to Bounty or its licensors. We grant you a limited, revocable license to use the site for its intended purpose under these Terms. Feedback you send us may be used without obligation to you.
Disclaimers
Except as written in an Order, Bounty is provided “as is” and “as available”. To the fullest extent allowed by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. Campaign results depend on many factors outside our control, including how Apple calculates its charts, and past results don't guarantee future results.
Limitation of liability
To the fullest extent allowed by law, Bounty won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim relating to Bounty is limited to the greater of the fees you paid us in the 12 months before the claim and US $100. Some jurisdictions don't allow these limits, so they may not apply to you.
Indemnity
You'll defend and indemnify Bounty against third-party claims arising from content you provide, your breach of these Terms, or your violation of law or third-party rights.
Suspension and termination
You can stop using Bounty at any time. We may suspend or end access if you breach these Terms or misuse the service. Sections that by their nature should survive, including ownership, disclaimers, limitation of liability and indemnity, survive termination.
Governing law
These Terms are governed by the laws of the jurisdiction where Bounty's operating company is registered, without regard to conflict-of-law rules. Disputes will be resolved by the competent courts of that jurisdiction, and you and Bounty consent to their jurisdiction, except where the law where you live gives you a right to bring a claim locally.
Changes
We may update these Terms. We'll revise the date at the top and, for significant changes, give notice on the site or by email. Continuing to use Bounty after changes take effect means you accept them.
